Mark Sanchez Agreed to Plead Guilty. The Filing Doesn't Name the Charge.

The former USC and NFL quarterback faces a felony battery count over a 2025 fight that left a truck driver badly hurt.

Mark Sanchez has agreed to plead guilty in Indianapolis, days before a jury trial that had already been continued five times. Prosecutors and lawyers for the former USC and NFL quarterback filed a joint motion in Marion County Superior Court asking Judge James Osborn to scrap the Sept. 8 trial date, Los Angeles magazine reported. The motion doesn't name the charge he's agreeing to plead to.

On the other side of the case is Perry Tole, a 69-year-old truck driver who was collecting used cooking oil in a loading area between two downtown Indianapolis hotels when the two men crossed paths. He came out of it with significant injuries, including a deep laceration to his face. He was never charged with a crime.

The motion asks Osborn to “set this matter for a guilty plea and sentencing hearing.” Sanchez hasn't entered the plea in court, and a judge has to accept the deal before it's binding.

He currently faces one Level 5 felony count of battery resulting in serious bodily injury, plus misdemeanors out of the same confrontation. A Level 5 felony in Indiana carries one to six years in prison.

His attorneys asked for the plea and sentencing hearing on Nov. 9 or Nov. 16. It's set for Nov. 9.

Nick Sanchez, his brother and legal adviser, framed the motion as progress toward closing out the case. “This is a positive development. We are finalizing an agreement with the prosecutor’s office that provides a path toward resolving the state’s case,” he said in a statement to the magazine.

The confrontation happened in the early hours of Oct. 4, 2025, when Sanchez was in Indianapolis working the Colts–Raiders game as part of Fox Sports’ broadcast team. Police alleged he smelled of alcohol, got into Tole’s truck without permission and shoved him, and that he kept advancing after Tole used pepper spray, the outlet reported, citing police and court records. Tole then drew a knife.

Sanchez was hospitalized with multiple stab wounds to his upper torso. He told investigators he remembered almost nothing; per the probable cause affidavit, he recalled reaching for a window and couldn't say who he'd fought or where it happened. Tole told investigators the stabbing was self-defense. In the records the magazine reviewed, prosecutors cast Sanchez as the aggressor. The felony battery count was added to the case after that.

The docket has moved around. Judge Jennifer Harrison recused herself in October 2025, Osborn took over, and he later undid a ruling that had kept cameras out, clearing the proceedings to be televised. The trial slid from December 2025 into 2026, then jury selection to May 28, then to the Sept. 8 date the lawyers have now asked to cancel.

The criminal case isn't the only one. Tole sued Sanchez and Fox Corporation days after the fight, and an amended complaint added Huse Culinary, Inc., operator of the Indianapolis restaurant St. Elmo’s Steakhouse, claiming it kept serving Sanchez while he was visibly intoxicated — negligence and dram shop claims under Indiana law. The complaint also accuses Fox of negligence in hiring, supervising and retaining him. Those are civil allegations and haven’t been proven in court.

Tole’s attorney, Matt Gotlicko, said discussions with Sanchez’s team have been productive and are heading toward an agreement, the magazine reported.

Osborn takes it up Nov. 9. Until he accepts a plea, the felony count stands as charged.
